Terms & Conditions

These Terms & Conditions govern your use of this online shop and every purchase made through it. Please read them together with our Privacy Policy, Cookies Policy and Returns & Refunds policy. By placing an order you confirm that you have read and accept these terms.

Who we are

Our products

We sell new items and authentic military surplus. Surplus goods are pre-owned and sold in “used” or “like new” condition — small marks, fading or minor repairs are part of their character and are described as accurately as we can. Photographs are representative; colours may vary slightly with screen settings and production batches. Insignia and equipment intended for public institutions are sold only to authorised persons, and we accept no liability for use outside the purposes permitted by law.

Placing an order and the contract

Product listings are an invitation to buy, not a binding offer. When you place an order you make an offer to purchase. The automatic confirmation e-mail acknowledges that we received your order but does not by itself conclude the contract. The contract is formed when we confirm the order (for example by accepting it or dispatching the goods); for pre-payment orders we may first issue a proforma invoice. We may decline or cancel an order if the goods are unavailable, the data provided are incomplete or incorrect, or an obvious pricing error has occurred (for example a zero or clearly wrong price).

Prices and payment

Prices are shown in the currency of the store you are shopping in and include VAT where applicable. The price that applies to your order is the one displayed at the moment you place it. We accept the payment methods shown at checkout — bank transfer to the accounts we display, and online card payment (Visa, Mastercard, American Express), including Apple Pay and Google Pay. Card payments are processed over a secure connection and we do not store your full card details.

Delivery

We ship with the couriers shown at checkout. Delivery times and costs are those indicated for your destination and order. If a parcel arrives visibly damaged, please note it with the courier and tell us as soon as possible.

Your right of withdrawal

If you are a consumer, you may withdraw from the contract within 14 days without giving any reason, under Romanian OUG 34/2014 (transposing EU Directive 2011/83/EU). Full details, exceptions and how to return the goods are set out in our Returns & Refunds policy.

Legal guarantee of conformity

As a consumer you benefit from the legal guarantee of conformity: the goods must match their description and be fit for normal use. If a product is not as it should be, you are entitled to have it brought into conformity (repair or replacement) or, where applicable, to a proportionate price reduction or a refund, under Romanian OUG 140/2021 (transposing EU Directive 2019/771). For used goods the relevant period may be shorter, as permitted by law. This guarantee is separate from, and additional to, your right of withdrawal.

Complaints and dispute resolution

If something is wrong, please contact us first at contact@militarysurplus.ro — we aim to resolve complaints quickly and fairly. As a consumer you may also contact the Romanian National Authority for Consumer Protection (ANPC, www.anpc.ro) and use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Site use and intellectual property

The content of this site (texts, logos, images and layout) is protected and may not be copied or used commercially without our permission. Please use the site lawfully and do not attempt to disrupt it.

Liability

We are liable for damage caused by our fault to the extent required by law. We are not liable for the use of products contrary to their purpose or the law, nor for delays caused by events beyond our reasonable control. Nothing in these terms limits your mandatory rights as a consumer.

Personal data

We process your personal data in accordance with the GDPR (Regulation (EU) 2016/679). Please see our Privacy Policy for what we collect, why, and the rights you have.

Governing law and changes

These terms are governed by Romanian and EU law. We may update them from time to time; the version that applies to your order is the one published here when you place it. Your mandatory consumer rights are not affected.
